In Labuan, the ideal mid-shore jurisdiction of Asia, foreigners are permitted to set up businesses and enjoy 100% ownership, a 3% corporate tax regime, and the freedom to deal with other companies in Malaysia. Directors and key employees of Labuan companies — along with their spouses and children below 21 years — are eligible to apply for a two-year renewable multiple-entry expatriate or professional visa.

Visa holders may choose to reside in West Malaysia, East Malaysia or Labuan itself. Those who prefer not to reside in Malaysia may still use the work permit for business meetings, bank account openings and other banking or business matters.

Expatriate / Professional Visa Approval Authorities

The two Malaysian authorities responsible for approving Labuan work permits are the Labuan Immigration Department and the Labuan Financial Services Authority (Labuan FSA). Once approval is granted, applicants are generally required to visit the Labuan Immigration Department in person to complete the issuance process.

Key Eligibility Requirements

The applicant must have a minimum monthly salary of MYR 10,000 as per their employment agreement with the Labuan company. The company must also maintain an operational office in Labuan. Only top management and key personnel are eligible to apply.

Processing typically takes three to four weeks from the date of submission. A visit to the Labuan Immigration Department is required upon approval to receive the physical work permit.
